Piden aprobar ley para prevención de la violencia contra las mujeres
SANTO DOMINGO. Líderes del movimiento feminista dominicano, así como funcionarios de la Procuraduría General de la República y del Ministerio de la Mujer afirmaron este jueves que urge la aprobación del proyecto de ley que crea el Sistema Integral para la Prevención, Atención, Sanción y Erradicación de la Violencia contra las Mujeres, al participar en un seminario celebrado en el Instituto Tecnológico de Santo Domingo (INTEC).
Tras afirmar que el flagelo de la violencia “sigue siendo tan grande y dramático, en términos de tamaño y características, que requiere mayor atención y un abordaje que ataque sus raíces”, la coordinadora del Centro de Estudios de Género del INTEC, Lourdes Contreras, consideró que el país demanda un mensaje de Estado en el que los poderes Ejecutivo, Judicial y Legislativo establezcan una agenda, que conecte con las alcaldías y los medios de comunicación, para lograr el fin de los feminicidios y todo tipo de violencia contra las mujeres.
Destacó que en lo que va del año, la ola de violencia ha cobrado la vida de más 49 féminas por lo que urge que el poder legislativo ordene, instruya, mande y ofrezca una orientación de cómo y con qué mecanismos frenarla.
Al participar del Seminario “Análisis acerca del proyecto de Ley que crea el Sistema Integral para la Prevención, Atención, Sanción y Erradicación de la violencia contra las mujeres”, la abogada e investigadora Susi Pola Zapico, dijo que, aunque la Ley Sobre Violencia de Intrafamiliar (24-97) fue una “verdadera revolución legislativa”, porque con su promulgación se reformó el Código Penal para tipificar como delito a la violencia contra las mujeres, tanto la intrafamiliar como la sexual, la misma no ha impactado en la reducción de los feminicidios.
Pola advirtió que la Ley 24-97 no establece un presupuesto nacional identificado y transparente para prevenir, atender y contener la violencia contra las mujeres. “Los recursos financieros en los diferentes programas e instituciones, aún del Estado, son puntuales y dependen de apoyos internacionales, la mayoría de las veces”, argumentó.
Dijo, además, que tampoco existe un presupuesto claro para el resarcimiento de las víctimas, pero sí la posibilidad de alguna acción muy puntual. Explicó que el país no cuenta con una política dirigida a la compensación, restablecimiento, recuperación y rehabilitación de las víctimas. Manifestó que, de aprobarse la ley, sometida en el Senado por el legislador Félix Bautista, en 2012, el Estado estaría obligado en crear estructuras operativas para que se den servicios de protección a las mujeres.
Al participar en un seminario en el que analizaron las ventajas de una legislación que aborde de manera integral la violencia y garantice el ejercicio pleno de los derechos humanos por parte de las mujeres, Carmen Pérez, directora de Articulación del Ministerio de la Mujer, sostuvo que la Ley 24-97 ha jugado su papel, pese a que la violencia contra la mujer, lejos de disminuir ha aumentado.
No obstante, la funcionaria advirtió que antes de promulgar el proyecto de ley es necesario realizar cambios al texto aprobado por el Senado, “aun cuando estos nos parecen muy importantes, correríamos el riesgo de perder lo ganado en esta larga batalla, además de sus implicaciones en términos de tiempo”.
Entre esos aspectos, Pérez destacó que la redacción actual tiene algunas definiciones, sobre todo las relacionadas con el concepto de género que son confusas y contradictorias. Observó necesario la inclusión de algunos principios y su definición tales como el de acceso a información oportuna, de orientación sexual, violencia intrafamiliar y de feminicidio.
El evento contó con la presencia de Sonia Díaz, viceministra de Políticas de Igualdad del Ministerio de la Mujer; Elías Muñoz, gerente de Asuntos Corporativos de Philip Morris Dominicana y Elsa Alcántara, decana del Área de Ciencias Sociales y Humanidades de INTEC. También participaron representantes de los ministerios de Educación, Salud Pública, Ministerio Público y el Consejo Nacional de la Niñez (CONANI).
