Escándalo por expediente depararecido que involucra español Ricardo Conde Diez
Santo Domingo.- La pérdida de un expediente que involucra al español Ricardo Conde Diez, quien acaba de ser condenado en su país a siete años de prisión por narcotráfico, marca una incidentada acusación en Higüey en contra de cinco presuntos integrantes de una red que encabeza el imputado, frente a la cual se han inhibido tres jueces, y tiene en su haber una retractación de la extinción de la acción penal.
La narración la hace en una carta dirigida a la Suprema Corte de Justicia, el director de la Procuraduría Especializada Antilavado de Activos, Germán Miranda Villalona, quien solicita una investigación sobre el particular.
El expediente del español, quien huyó del país tras serle incautados 20 bienes inmuebles, como solares, lujosas villas, plazas comerciales, residenciales, apartamentos y un avión, tiene un proceso abierto por lavado.
El Ministerio Público explica que la jueza apoderada del proceso, Vanessa Contreras, tuvo que fijar para el 7 de mayo la continuación de la audiencia, “por motivo de que se perdió el expediente”.
Plantea que la magistrada declaró que iba a proceder a hacer un informe sobre el caso.
Los 20 bienes inmuebles incautados al fugitivo están en la zona turística de Uvero Alto, ubicadas en el municipio Higüey, en los cuales hay lujosas edificaciones.
Miranda Villalona destacó que sobre esas importantes incautaciones, el Ministerio Público está solicitando un decomiso a favor del Estado dominicano, por lo que debe ser investigado el caso.
Planteó que recibió una solicitud de cooperación judicial de las autoridades penales del Reino de España, en el 2009, y producto de la misma resultaron afectados inmuebles en la República Dominicana, como parte de la acusación de lavado de activos del conocido como Rubén Santos Ortega, de nacionalidad venezolana.
Destaca que posteriormente, fue identificado como Ricardo Diez Conde, ciudadano español.
Indica que todas las actuaciones referentes al imputado, así como también a otros relacionados con el entramado societario de compañías constituidas en Panamá y en islas Vírgenes Británicas, fueron remitidas a dichas autoridades.
Sostiene que como consecuencia de esa prestación de cooperación resultaron investigados dominicanos que presuntamente eran el brazo de apoyo en el país de Ramos Ortega o Diez Conde, y lograron esconder activos de éste y su organización criminal colocándolos a nombre de ellos y sus familias.
Plantea que el Ministerio Público procedió a presentar acusación por ante el Juzgado de la Instrucción de La Altagracia en contra de Manuel Merilio Quezada Gómez, Peggy Josefina Quiñonez Irrizarry, Joaquín Eugenio Contreras Hixon, María Teresa Calle Rueda y Sonia Mercado.
La primera audiencia se celebró el 20 de abril del 2012, y fue decretada por resolución del juez Yohan Carlos Morales Peguero la rebeldía de los imputados.
Asimismo, luego fue levantada la rebeldía, y posteriormente se celebraron varias audiencias. El 24 de octubre del 2013, la imputada María Teresa Calle Rueda retiró en plena audiencia un acuerdo penal abreviado al que había arribado con el Ministerio Público, admitiendo los hechos.
Miranda Villalona narra que el juez Morales Peguero declaró extinguida la acción penal en contra de los imputados, pero al percatarse que había tomado una decisión equivocada, emitió otra resolución dejando sin efecto la decisión.
Precisa que el 6 de agosto del 2014, la Cámara Penal de la Corte de Apelación de San Pedro de Macorís acogió la inhibición del magistrado, designando para conocer el proceso al juez Edwis Rijo Delgado, quien fijó audiencia para conocer el caso, pero durante la misma también se inhibió.
La Corte acogió la inhibición, y puso a cargo del expediente a la jueza Karuchi Sotero Cabral, quien tras varios meses con el expediente presentó su inhibición.
La abstención de participar en el proceso de la magistrada fue acogida, y designaron a Vanessa Contreras, quien había fijado audiencia para el 16 de abril.
