Coerción a imputados en caso Odebrecht abre debate entre abogados
SANTO DOMINGO. Las medidas de coerción impuestas a los imputados del escándalo de corrupción de Odebrecht, por el juez de la instrucción especial, Francisco Ortega Polanco, han desatado diversas opiniones de abogados, quienes por un lado la consideran atinada y por otro excesiva.
El abogado José Parra Báez entiende que la decisión emitida por el magistrado Ortega Polanco es razonable, ya que permite avizorar una salida judicial adecuada respecto del ilícito penal imputado a los sometidos al proceso.
A su juicio, la medida se colocó atendiendo al grado de involucramiento en el crimen de cada señalado, lo que permite deducir la aplicación del principio de proporcionalidad por parte del juzgador.
Para José Alberto Ortiz, al magistrado considerar que todos eran pasibles de medidas de coerción es porque entendió que tenían probabilidades de ser autores o cómplices de las imputaciones del Ministerio Público.
Aunque aguarda las motivaciones del juez, dijo que al parecer la decisión que lo llevó a imponer coerción fue su entendimiento de la gravedad del caso y de las probabilidades de condenas de cada uno.
Mientras el también abogado Carlos Díaz, considera que con la resolución fueron transgredidos algunos derechos de los imputados, toda vez que la ley establece la imposición de prisión cuando corre peligro la investigación, las víctimas o si estos pudieran sustraer el proceso y “ninguna se cumplía en este caso”.
“El hecho de que uno de ellos fuera enviado a La Victoria tiene un acto denigrante, hubo aspectos que dan entender que hubo transgresión de derecho”, manifestó.
De su lado, Rodolfo Valentín asegura que el proceso se extendió demasiado y en todo momento tuvo un matiz de juicio de fondo y no de solicitud de medidas de coerción; hubo muchos excesos, debió ser una vista sencilla y simple”.
En tanto, Félix Damián Olivares planteó que el juez debió explicar las razones para decidir las medidas de coerción, ya que habían personas con sobrados arraigos y que no representaban peligro de fuga. “En situaciones normales, esas personas no eran merecedoras de una prisión preventiva’, apuntó.
El traslado a las cárceles de Najayo y La Victoria de los 8 imputados en el escándalo de corrupción de Odebrecht no se pudo ejecutar ayer, debido a que la Fiscalía del Distrito Nacional no ha sido notificada de la resolución de la medida de coerción emitida por el juez de la instrucción especial, Ortega Polanco. En ese sentido no fue remitido a la penitenciaría de La Victoria el imputado Ángel Rondón, así como a Najayo a Víctor Díaz Rúa, Conrado Pitaluga, Juan Temístocles Montás, Andrés Bautista, Ruddy González, César Sánchez y Máximo De Óleo. Tampoco se ha podido disponer del arresto domiciliario de Radhamés Segura y Roberto Rodríguez.
Familiares y amigos de Rondón acudieron al recinto penitenciario de La Victoria para supervisar los trabajos de adecuación de la celda adonde se espera que sea trasladado el empresario para cumplir un año de prisión preventiva.
